El concepto de trastorno mental permite justificar intervenciones médicas, psicológicas y judiciales. Además, facilita a la/el consultante acceder a tratamientos mediante reembolsos o programas de salud pública, y por otro lado, podría conllevar estereotipos sociales. No obstante, el significado de dicho concepto no ha dejado de suscitar debate. En el presente artículo argumentaré que los trastornos de personalidad, tal como son definidos en el DSM-5, no cumplen con los criterios de patología de las propuestas principales (i.e. teoría bio-estadística de la (...) salud, disfunción dañina, o entidad patológica) debido a tres razones independientes: (i) no se han propuesto dis/funciones a la base de cada trastorno y, dado el estado del arte de la psicología evolucionista, es poco probable que se pueda llevar a cabo ese programa en el futuro; (ii) el concepto de daño (distrés, perjuicio) aplicable a los trastornos de personalidad es constitutivamente social (aunque no exclusivamente social), por lo que resulta más adecuado hablar de grados de discapacidad que de trastornos del individuo; y (iii) que la ausencia de condiciones patognomónicas para cada trastorno, junto a la elevada comorbilidad y multimorbilidad entre trastornos de personalidad, horada la validez de la nosología actual y de los diagnósticos diferenciales. Propondré como solución la eliminación de los trastornos de personalidad de la nosología psiquiátrica. Eliminar los trastornos de personalidad no equivale a desconocer el sufrimiento de las personas diagnosticadas, ni a ignorar que dicho sufrimiento precede a, –y no acaba con la disolución de– la etiqueta diagnóstica. Por ello, se propondrá una reconceptualización de dicho sufrimiento en términos de discapacidad, entendida desde el modelo social, y que no presupone patología. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. An essential requirement for increasing human confidence in computer systems is knowing an event’s origin. Therefore, it is necessary to have an efficient method to record such information. It is especially challenging in robotics, where unexpected behaviours can have unpredictable consequences, endangering the interests of people or even their safety. Furthermore, to analyse an incident’s cause or anticipate future behaviours, we must identify the events that cause a specific action. Although it is common to use logging systems for such purposes, (...) issues such as partial recording of events, unhelpful data or the impact on robot performance suggest conceiving new accountability solutions that assist when determining the responsible entities or the provenance of specific information. This paper presents a general-purpose approach to developing an accountability system for autonomous robots. It consists of four main components: a system event logger, a message producer, a distributed event streaming platform and a database. Our proposal is completely decoupled from the monitored system and allows real-time analysis, improving flexibility, besides system protection and transparency. Finally, the need to reduce the impact of the audit process and logging tasks on robot performance has promoted the development of different assessment scenarios to determine the best strategy for providing accounting services. Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

Desde esta perspectiva, Rancière nos revelaría que era esta política de la literatura la que estaba operando inconscientemente en el proyecto de una arqueología de las instituciones y de los saberes, al mismo tiempo que era este último filósofo quien heredaba parte del método foucaultiano, donde se descubrían las potencialidades estéticas y escriturales de la literatura como discurso que pone en juego el poder. The US has built the most extensive immigration detention system globally. Over the last three administrations, several organizations have noted a systemic failure in the provision of health care in detention centers, leading to the torture and death of immigrants. This essay develops the principle of the preferential option for the poor to examine the causes of deficient access to health care and solutions to overcome them. It analyzes the substandard health care in detention centers from the notion of structural (...) violence and systematizes solutions of grassroots immigrant organizations from the idea of solidarity, understood here as a form of friendship with the poor that moves toward relational justice. Its goal is to build bridges between people so that the political will is generated to create policies to improve and enforce health care standards in detention centers and address the unjust foundations of immigration detention. Este texto examina las relaciones entre misioneros católicos y de estos con los protestantes en la zona fronteriza del Vaupés colombo-brasileño. La presencia de católicos comenzó en la zona en 1914 y no es nada despreciable pues cerca de 450 religiosos entre sacerdotes y monjas llegaron a la región. Los protestantes pertenecientes a dos organizaciones de origen norteamericano arribaron treinta años después y alcanzaron una cifra de 115 miembros. Sus relaciones como su impacto diferencial sobre las poblaciones misionadas son un (...) tópico poco desarrollado en las historias de misión, que en este texto se ilustra a través de la consulta de fuentes primarias que detallan los vínculos o visiones de miembros de distintos credos sobre sus contrapartes. Mass shootings have become an all-too-normal occurrence in contemporary society in our country. Although we are still impacted by every one of them, there is a concern that we are slowly becoming desensitized to the unspeakable actions of violence that are being carried out regularly. After the initial shock, the typical reaction to such actions involves a clichéd response (...) calling for thoughts and prayers, as if thoughts and prayers were enough to prevent the next incident every other time that people have called for them. In attempting to debunk moral realism through an appeal to evolutionary facts, debunkers face a series of problems, which we label the problems of scope, corrosiveness, and post‐hoc justification. To overcome these problems, debunkers must assume certain metaphysical or epistemological positions, or otherwise pre‐establish them. In doing so, they must assume or pre‐establish the very conclusion they seek in advancing the argument. This means that such debunking arguments either beg the question against the moral realist or are undermined as standalone (...) metaethical arguments. (shrink)

Playing soccer in public parks, participating in parades, or marching in religious processions are public performances that express membership in a political community. When these practices are performed by noncitizens, they highlight how the public space—in its physical and symbolic character—is not a space exclusive to members of the political community. Rather, public space is a terrain subject to contestation. In this article, I explore the ways Mexican migrants in New York City use and appropriate public spaces and in doing (...) so expand the boundaries of the political community. I argue that by gaining access to public spaces, appropriating them, and then transforming them, noncitizens claim recognition as members of the political community and thus unsettle its boundaries. This book presents an original thesis about the notion of sensory experience and of the mind’s architecture, which is grounded in current trends in cognitive science and philosophy of mind. Presented in the form of a dialogue, the book explores some of the psychological and philosophical consequences that the author derives from his proposal.

Nietzsche understands that the world unfolds as a will to power. If we want to properly understand this cosmological perspective, we must start by attributing immanent activity not only to organisms, but also to beings called “inorganic”. With this in mind, in this article we examine, in an “ascending” way, the features of the vital becoming in both strata, that is, from the minerals, with their attractions and repulsions, until reaching the man himself and his conscious operations. All the problems (...) involved in this monistic perspective are approached from argumentations that are based on Nietzsche’s readings. Strauss, Dubois Reymond, Herzen, Spencer, Lange, Delfœuf, are some of the cited sources that allow this writing to give an account of how Nietzsche makes life prevail, beyond being, as the primordial phenomenon in all orders. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

El objetivo de este texto es una aproximación teórica de la infancia en las principales concepciones de la filosofía occidental, la nueva historia social de la infancia en el continente y las principales poéticas estéticas del cine latinoamericano durante la segunda mitad del siglo XX. Para este propósito se analizan las nociones de la infancia desde trabajos con un enfoque histórico-hermenéutico, de análisis crítico de discurso y evaluación de las nociones con base en los aportes de los campos teóricos abordados. Estos cruces permiten pensar los lugares de la infancia como instrumento para lograr un sueño político, las concepciones del tiempo, los derechos liberales de la Ilustración, y el acontecimiento fenomenológico. El fin de esta revisión crítica es un llamado a tejer líneas de fuga de la historia, a recrear mecanismos de resistencia audiovisual que apueste por una estética imperfecta, que desdibuje herencias, que marque procesos sociales en los que la infancia tenga una voz auténtica. Al enfocar la imagen de la infancia resulta crucial que el cine, más allá de mostrar realidades fácticas concretas, tenga un margen de ficción que aprovecha para darnos una poética sentimental de las infancias olvidadas y reinventar la estetización de las nuevas infancias en re-existencias autónomas desde la pluralidad de miradas del continente. Em contraste com essa crítica, o presente trabalho defende a tese de que o princípio não está suscetível a essa pretensa confusão, utilizando, para tanto, a distinção leibniziana entre “a consideração do modo de conceber” e a “consideração da coisa mesma”. Se expone en él, primeramente, la producción literaria de Abasolo y la nula receptividad que su obra tuvo en los círculos intelectuales de su tiempo, aludiendo, a la vez, al concepto central de su filosofía, es decir, la idea de personalidad. Luego, y más extensamente, se presentan las consideraciones de Abasolo respecto de algunas de las problemáticas sociales y económicas discutidas en los inicios de la República, abordando temas como la moral, (...) la religión, el fin social y la libertad. This artick is a treatise on the Chilean philosopher Jenaro Abasólo. Vrimarilj, it exposes Abasólo, his literary production, and the complete lack of attention that his oeuvre recieved from the intellectual áreles of his period. It alludes, at the same time, to the central concept of his philosophy, Le., the idea of personality. Later and more extensively, it presents Abasolo’s considerations regarding social and economic issues discussed at the beginning of the Republic, addressing topics such as morality, religión, social order and freedom. Background Decisions regarding Cardio-Pulmonary Resuscitation (CPR) and Do Not Attempt Resuscitation (DNAR) orders remain demanding, as does including patients in the process. Objectives To explore physicians’ justification for CPR/DNAR orders and decisions regarding patient inclusion, as well as their reports of how they initiated discussions with patients. Methods We administered a face-to-face survey to residents in charge of 206 patients including DNAR and CPR orders, with or without patient inclusion. Results Justifications were provided for 59% of DNAR orders and included (...) severe comorbidity, patients and families’ resuscitation preferences, patients’ age, or poor prognosis or quality of life. Reasons to include patients in CPR/DNAR decisions were provided in 96% and 84% of cases, and were based on respect for autonomy, clinical assessment of the situation as not too severe, and the view that such inclusion was required. Reasons for not including patients were offered in 84% of cases for CPR and in 70% for DNAR. They included absent decision-making capacity, a clinical situation viewed as good (CPR) or offering little hope of recovery (DNAR), barriers to communication, or concern that discussions could be emotionally difficult or superfluous. Decisions made earlier in the patient's management were infrequently viewed as requiring revision. Residents reported a variety of introductions to discussions with patients. Conclusions These results provide better understanding of reasons for CPR/DNAR decisions, reasons for patient inclusion or lack thereof, and ways in which such inclusion is initiated. They also point to potential side-effects of implementing CPR/DNAR recommendations without in-depth and practical training. This should be part of a regular audit and follow-up process for such recommendations. (shrink)

Además de las coordinadoras Joice Barbosa y Moira Pérez, participan Silvina Tapia Tapia de Ecuador, Abdourahmane Seck de Senegal y Verónica Figueroa Huencho de Wellmapu, quienes se desempeñan tanto en el ámbito académico como en el campo social mediante el activismo político y/o comunitario, desde el cual producen conocimientos colectivos de carácter situado. A lo largo de la conversación se analizan temas tales (...) como la expresión de formas contemporáneas de neoconservadurismo y autoritarismo, las disputas de los movimientos sociales con la institucionalidad, sus tensiones con un Estado que tiende a la cooptación pero también mantiene profundas lealtades capitalistas y coloniales, y las posibilidades y experiencias de formas alternativas de organización colectiva y comunitaria. Además, se explora cuál es y cuál puede ser en este escenario el rol de la academia y de quienes trabajan en ella, en la tensión entre los compromisos institucionales y la política radical. (shrink)

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. Porque la realidad suele ser, a veces, tan atribulada que es necesario ponerle la ilusión de la literatura. Esta advertencia del poeta de los heterónimos sugiere que para poder comunicar nuestras impresiones y sentimientos, tenemos que traducirlos a literatura; que, en gran medida, la transmisión de sentimientos es, en el fondo, un acontecer de modelos literarios que se toman de la literatura para llevarlos a la vida real y no al contrario. El artículo aborda el comportamiento de los precios, salarios y deuda morosa de las familias como una aproximación a la comprensión de las causas de la movilización social en Chile desde 2019. Si bien este país ha mostrado sólidos fundamentos macroeconómicos durante los últimos treinta años, estos han escondido importantes cuellos de botella para las familias como alzas de precios de bienes y servicios sensibles para la población, salarios estancados, una de las distribuciones del ingreso más desiguales del mundo, un (...) mercado laboral heterogéneo y el crecimiento galopante de la deuda morosa de los mayores de dieciocho años. Se plantea que estas insatisfacciones económicas han puesto en apuro a las familias chilenas, especialmente a las más vulnerables y la clase media, las que exigen cambiar el modelo de desarrollo. Reconstructing the genetic traits of the Last Common Ancestor and the Tree of Life are two examples of the reaches of contemporary molecular phylogenetics. Nevertheless, the whole enterprise has led to paradoxical results. The presence of Lateral Gene Transfer poses epistemic and empirical challenges to meet these goals; the discussion around this subject has been enriched by arguments from philosophers and historians of science. At the same time, a few but influential research groups have aimed to reconstruct the LCA with (...) rich-in-detail hypotheses and high-resolution gene catalogs and metabolic traits. We argue that LGT poses insurmountable challenges for detailed and rich in details reconstructions and propose, instead, a middle-ground position with the reconstruction of a slim LCA based on traits under strong pressures of Negative Natural Selection, and for the need of consilience with evidence from organismal biology and geochemistry. We defend a cautionary perspective that goes beyond the statistical analysis of gene similarities and assumes the broader consequences of evolving empirical data and epistemic pluralism in the reconstruction of early life.
